This General Liability Waiver and Release of Liability (“Agreement”) is entered into by and between Siavash Bonakdar, including its owners, operators, crew members, agents, affiliates, contractors, representatives, charterers, event organizers, and any associated parties (collectively referred to as the “Released Parties”), and the undersigned participant(s) (“Participant”).
By boarding, entering, remaining upon, or participating in any activity aboard the vessel RACHEL, the Participant voluntarily acknowledges and agrees to all terms and conditions contained herein.
Participant understands and acknowledges that being aboard a yacht and participating in marine or water-related activities involves substantial inherent risks, including slipping, falling, drowning, collisions, vessel movement, rough seas, weather conditions, boarding accidents, equipment malfunction and other risks. Participant voluntarily and knowingly assumes all risks, known and unknown, associated with participation aboard the vessel.
Participant hereby fully releases, waives, discharges, and covenants not to sue the Released Parties from any and all liability, claims, demands, damages, causes of action, injuries, illnesses, losses, expenses, attorney’s fees, or death arising from or related to participation aboard the vessel, to the fullest extent permitted under Florida law.
Participant acknowledges that alcoholic beverages may be consumed aboard the vessel and voluntarily accepts the associated risks of intoxication or impairment.
Participant accepts full personal responsibility for their own actions, safety, conduct, supervision of minors under their care, and physical condition while aboard the vessel.
Participant certifies that they are physically and mentally fit to participate in activities aboard the vessel and have no condition that would create unreasonable risk to themselves or others.
Participant agrees to indemnify, defend, and hold harmless the Released Parties from and against claims, lawsuits, liabilities, damages, costs, or expenses arising from Participant’s conduct, negligence, intoxication, actions, or violations of law while aboard the vessel.
Participant acknowledges that the Released Parties are not responsible for monitoring or supervising the conduct, sobriety, or actions of guests aboard the vessel.
Participant understands that the Released Parties are not responsible for any lost, stolen, or damaged personal property.
Participant authorizes emergency medical treatment if deemed necessary and agrees that any related expenses shall be solely the responsibility of the Participant.
If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
This Agreement shall be governed by and interpreted under the laws of the State of Florida.
